An excerpt from the column by Kathleen Parker on Bart Stupak that was featured today in the Washington Post, Chicago Tribune and other major newspapers across the country:

Poor Bart Stupak. The man tried to be a hero for the unborn, and then, when all the power of the moment was in his frail human hands, he dropped the baby. He genuflected when he should have dug in his heels and gave it up for a meaningless executive order.

Now, in the wake of his decision to vote “yes” for a health care bill that expands public funding for abortion, he is vilified and will be forever remembered as the guy who Stupaked health care reform and the pro-life movement.

Of all the disappointed activists,, president of CatholicVote.org and creator of StandWithStupak.com, was perhaps the most demonstrative in his support of pro-life Democrats. He even created a video with a remake of the final battle scene from “Braveheart.”

A helmeted British Barack Obama says, “Our cavalry will ride them down like grass. … Full attack!” Whereupon, Stupak, eyeglasses incongruously perched on his blue-painted face, commands his pitchfork army, “Steady. … Hold, hold, hold.”

Joe Biden introduced President Obama today at a get-together that was hopefully more of a mass political funeral visitation than a health care bill signing ceremony, but in any case, Biden proved he’s still in “stand-up comic” mode when he reminded Americans that further debt and loss of freedom will make everybody richer:

In his opening remarks, Vice President Joe Biden noted that the Roman poet Virgil wrote that “health is wealth” — and that the signed law would make “Americans a lot more wealthy.”

Just as a reminder for Biden, the poet Virgil also wrote, “His sickness increases from the remedies applied to cure it,” and “Curst greed of gold, what crimes thy tyrant power has caused.” As Biden introduced Obama at the bill signing, an open mic caught Joe telling the president, “This is a big f-ing deal.” For a second there I thought Chuck stood up.

After months of insisting that health care reform does not and will not include federal funding for abortion, President Obama is now considering issuing an executive order, after passage of the health care reform bill, that will state that the legislation does not include funding for abortion.

However, if the bill excludes federal funding for abortion, why is an executive order necessary?

The answer, of course, is that President Obama and the Democratic leadership know that the Senate health care reform bill includes subsidies for insurance plans that cover abortions, could possibly lead to abortion coverage mandates for insurance companies, and does not prevent other funds in the legislation from directly paying for abortions.

The question then becomes, can an executive order correct all of the abortion-related problems in the bill?

The answer is a resounding no. While a carefully worded executive order might be able to take care of some of the mandate concerns, it cannot correct all of the abortion-related problems with the bill. A statute cannot be undone by an executive order or regulation. For example, an Executive Order cannot prevent insurance plans that pay for abortions and participate in the newly-created exchanges from receiving federal subsidies, because this allowance is explicitly written in the bill.

The fact that statutes cannot be overridden by executive orders or regulations has been repeatedly affirmed by the United States Supreme Court. In 2006, the Supreme Court struck down an executive order issued by President Bush to invoke military commission jurisdiction over Hamdan because Congress had impliedly prohibited this action. Hamdan v. Rumsfeld, 548 U.S. 557, 579-80 (2006).

Further, Executive Orders can be undone or modified as quickly as they are created. In spite of the fact that the American people overwhelmingly do not want to see their tax dollars go toward abortion, we continue to see restrictions on federal funding for abortions reduced to executive orders, appropriations riders, and regulations. The majority of Americans want to see a prohibition on federal funding for abortion included in permanent, statutory law.

Congress failed to deliver a statutory prohibition on abortion funding in health care reform, and an executive order cannot do the job.

Dannenfelser stated:

“The executive order on abortion funding does absolutely nothing to fix the problems presented by the health care reform bill that the House will vote on this evening. The very idea should offend all pro-life Members of Congress. An executive order can be rescinded at any time at the President’s whim, and the courts could and have a history of trumping executive orders. Most importantly, pro-abortion Representatives have admitted the executive order is meaningless.”

Dr. Charmaine Yoest, President & CEO of Americans United for Life Action:

“Once again, the proposal to address the problem of abortion funding in the health care bill through use of an executive order is a tacit acknowledgement that the bill as it stands is pro-abortion legislation. Both the President and the Speaker have repeatedly denied this stark fact.

Furthermore, the AUL legal team has concluded that an executive order is not an adequate fix to mitigate the Senate bill’s establishment of taxpayer-funded abortion.  For example, an executive order cannot prevent insurance companies that pay for abortions in the exchanges from receiving federal subsidies.

In addition, executive orders can be undone or modified as quickly as they are created. President Obama revoked the Mexico City Policy, through the use of an executive order, and thereby allowed federal tax dollars to finance organizations that provide abortions internationally for the first time in years.

This fact, coupled with the Administration’s repeated endorsement of the pro-abortion lobby’s agenda, force any reasonable person to conclude that this bill will clearly create the largest expansion of taxpayer-funded abortion in American history.”

Noting Israel history of peace overtures in the Middle-east Charles Krauthammer asks:

Why did President Barack Obama choose to turn a gaffe into a crisis in U.S.-Israeli relations?

And a gaffe it was: the announcement by a bureaucrat in the Interior Ministry of a housing expansion in a Jewish neighborhood in north Jerusalem. The timing could not have been worse: Vice President Joe Biden was visiting, Jerusalem is a touchy subject, and you don’t bring up touchy subjects that might embarrass an honored guest.

But it was no more than a gaffe. It was certainly not a policy change, let alone a betrayal. The neighborhood is in Jerusalem, and the 2009 Netanyahu-Obama agreement was for a 10-month freeze on West Bank settlements excluding Jerusalem……………………..


Clinton’s spokesman then publicly announced that Israel was now required to show in word and in deed its seriousness about peace.

Israel? Israelis have been looking for peace — literally dying for peace — since 1947, when they accepted the U.N. partition of Palestine into a Jewish and Arab state. (The Arabs refused and declared war. They lost.)……………………

So why this astonishing one-sidedness? Because Obama likes appeasing enemies while beating up on allies — therefore Israel shouldn’t take it personally (according to Robert Kagan)? Because Obama wants to bring down the current Israeli coalition government (according to Jeffrey Goldberg)?

Or is it because Obama fancies himself the historic redeemer whose irresistible charisma will heal the breach between Christianity and Islam or, if you will, between the post-imperial West and the Muslim world — and has little patience for this pesky Jewish state that brazenly insists on its right to exist, and even more brazenly on permitting Jews to live in its own ancient, historical and now present capital?

Who knows? Perhaps we should ask those Obama acolytes who assured the 63 percent of Americans who support Israel – at least 97 percent of those supporters, mind you, are non-Jews — about candidate Obama’s abiding commitment to Israel.

Last night, Rep. DeGette told The Huffington Post, “If there was an executive order saying they weren’t going to use federal funds in the bill to pay for abortions that would be fine with me.”

Today, Rep. Wasserman Schultz admitted to Fox News’ Megyn Kelly that “an executive order cannot change the law.”

The United States Conference of Catholic Bishops pointed out today that “only a change in the law enacted by Congress, not an executive order, can begin to address this very serious problem in the legislation.”

The Susan B. Anthony List has been leading the fight against abortion funding in health care reform for over a year, spending nearly $2 million on a grassroots campaign of targeted television and radio ads, 1.3 million automated calls, 70,000 patch-through constituent calls, 1.2 million letters and petitions to Congress, two media and grassroots tours in pro-life Democratic districts, television ads in six districts and comprehensive polling in 20 pro-life Democratic districts.

Michael W. McConnell: The Health Vote and the Constitution—II – WSJ.com.

Mr. McConnell, a former federal judge on the U.S. Court of Appeals for the Tenth Circuit, is a law professor at Stanford University and director of the Stanford Constitutional Law Center:

In just a few days the House of Representatives is expected to act on two different pieces of legislation: the Senate version of the health-care bill (the one that contains the special deals, “Cadillac” insurance plan taxes, and abortion coverage) and an amendatory bill making changes in the Senate bill. The House will likely adopt a “self-executing” rule that “deems” passage of the amendatory bill as enactment of the Senate bill, without an actual vote on the latter.

This enables the House to enact the Senate bill while appearing only to approve changes to it. The underlying Senate bill would then go to the president for signature, and the amendatory bill would go to the Senate for consideration under reconciliation procedures (meaning no filibuster).

This approach appears unconstitutional. Article I, Section 7 clearly states that bills cannot be presented to the president for signature unless they have been approved by both houses of Congress in the same form. If the House approves the Senate bill in the same legislation by which it approves changes to the Senate bill, it will fail that requirement.

One thing is sure: To proceed in this way creates an unnecessary risk that the legislation will be invalidated for violation of Article I, Section 7. Will wavering House members want to use this procedure when there is a nontrivial probability that the courts will render their political sacrifice wasted effort? To hazard that risk, the House leadership must have a powerful motive to avoid a straightforward vote.

Mr. McConnell, a former federal judge on the U.S. Court of Appeals for the Tenth Circuit, is a law professor at Stanford University and director of the Stanford Constitutional Law Center.

The People are speaking out about their distrust of the health care bill but is Congress listening.

What about the President? The man is a more concerned with himself than he is with the People and their will.  It’s still all about him. It’s still all about his presidency.  His present last ditch effort amounts to ‘Please save me!’

“There are serious implications of losing on President Obama’s ability to be effective for the rest of his three years in office,” Waxman told POLITICO. “That’s a message [undecided members] need to hear. If they don’t think that affects them if they are reelected, they are burying their heads in the sand.”

But many Democrats simply aren’t buying it after months of what they view as Obama’s disengagement from the health care battle.

“We’ve always known he’s a fourth-quarter player, and it’s great to see him on the field,” said an aide to a senior House Democrat. “So why did he sit on the sidelines for the last eight months?”

Rep. Stephen Lynch (D-Mass.), a firm “no” vote, has politely rebuffed feelers from Obama’s staff and rejects the idea that he can’t survive a defeat on health care.

Charles Krauthammer praises rotation of power:

“Barack Obama is now commander in chief. The lack of opposition (to our presence in Iraq and the war in Afghanistan) is not a matter of hypocrisy. It is a natural result of the rotation of power. When a party is in opposition, it opposes. That’s its job. But when it comes to power, it must govern. Easy rhetoric is over, the press of reality becomes irresistible. By necessity, it adopts some of the policies it had once denounced. And a new national consensus is born.”

Krauthammer further explains:

“The rotation of power is the finest political instrument ever invented for the consolidation of what were once radical and deeply divisive policies. The classic example is the New Deal. Republicans railed against it for 20 years. Then Dwight Eisenhower came to power, wisely left it intact, and no serious leader since has called for its repeal.

Similarly, Bill Clinton consolidated Reaganism, just as Tony Blair consolidated Thatcherism. In both cases, center-left moderates brought their party to accept the major premises of the highly successful conservative reforms that preceded them.

A similar consolidation has happened with many of the Bush anti-terror policies. In opposition, the Democrats decried warrantless wiretaps, rendition, and detention without trial. But now that they are charged with protecting us from the bad guys, they’ve come to view these as indispensable national security measures.”
